BIR Warns Judges and Taxpayers: “Do not TRO our Tax Collection”


Quezon City, 07 May 2010 – The Bureau of Internal Revenue (BIR) issued recently Revenue Memorandum Order No. 42-2010 pointing out the legal provisions in the Tax Code that no Court except the Court of Tax Appeals (CTA) has the authority to prohibit BIR from collecting taxes imposed by the said Tax Code. This prohibition applies to issuance of temporary restraining order (TRO) on all collection activities, service of warrants of distraint and garnishment, levy on final decisions of the BIR on disputed assessments, cases filed before the CTA and the sale of property distrained and garnished. BIR FORGIVES MMDA WITH LIFTING OF FREEZE ON BANK ACCOUNTS


In response to a request by Metropolitan Manila Development Authority (MMDA) Chairman Oscar Inocentes for the Bureau of Internal Revenue (BIR) to lift its garnishment of MMDA’s bank accounts and for a “reinvestigation of the assessed tax or a possible abatement of tax liability”, BIR Commissioner Joel Tan-Torres instructed his personnel to immediately accomodate the request. The BIR served Warrants of Garnishment on several bank accounts of the MMDA last March 24, 2010 for MMDA’s failure to settle its withholding tax liabilities for the years 1997, 2000 and 2001 amounting to P 116,451,132.98. TMAP Vows to Assist BIR this Tax Filing Season


Quezon City, 18 March, 2010 – As partner of the bureau to improve delivery of service to taxpayers through the Handang Maglingkod Program that would encourage voluntary compliance, the Tax Management Association of the Philippines, Inc., forged a Memorandum of Agreement with the Bureau of Internal Revenue on Tuesday, March 9, 2010, to establish a Taxpayer’s Assistance Center that would provide assistance to taxpayers this income tax filing season. Videoke, Karaoke Bars Subject to 18% Amusement Tax, Not VAT


BIR Commissioner Joel L. Tan-Torres signed last March 8, 2010 Revenue Memorandum Circular (RMC) 18-2010 clarifying the coverage and taxability of amusement places.

“This so-called amusement places” according to Commissioner Tan-Torres, now includes “videoke bars, karaoke bars, karaoke televisions, karaoke boxes and music lounges” which were previously called night or day clubs and cabarets.” Continue reading
