Mandaluyong City 08 December 2010 – The Bureau of Internal Revenue (BIR) today padlocked another business establishment in Mandaluyong City for committing acts constituting violations of the Tax Code.
Shuttered was ABC STAR COMMODITIES, INC. located at No. 777 Katarungan Street, Plainview, Mandaluyong City for failure to pay correct income tax, attempt to avoid or defeat tax, perjury and failure to pay correct Value-Added Tax (VAT).
Investigation by the BIR revealed that the company understated its sales for purposes of the Value Added Tax (VAT) by P9,178,812.89 or 60.39% for taxable year 2007 and by P11,667,734.98 or 96.62% for taxable year 2008.
Total deficiency tax liability of the corporation for the said taxable years, including increments, amounted to P4,598,066.57 broken down as follows: 2007 – P2,147,842.22; and 2008 – P2,450,224.35.
A 48-Hour Notice was issued by Revenue District Office (RDO) No. 41, Mandaluyong City informing the subject taxpayer of the findings and to make some rectifications which it failed to make. A Five (5)–Day VAT Compliance Notice was issued thereafter and again, the taxpayer failed, refused and/or neglected to refute and/or comply with the findings of the BIR.
The failure of the subject corporation to comply with the above notices led to the issuance of a Closure Order signed by BIR Operations Group Deputy Commissioner Nelson M. Aspe.
The said Closure Order was implemented by Revenue District Office No. 41, Mandaluyong City led Revenue District Officer Isabel A. Paulino and Assistant Revenue District Officer Olivia O. Amanse together with Revenue Region No. 7, Quezon City Office-In-Charge Assistant Director Jonas DP. Amora.
The closure of ABC STAR COMMODITIES, INC. was made pursuant to the Oplan Kandado flagship project of the BIR under the leadership of Commissioner Kim S. Jacinto-Henares.
